Terms of Service

These Terms of Service (“Terms”) govern your use of the Wishkister mobile application (the “App”), operated by Ilya Yushkov, an individual developer based in the Czech Republic (“we”, “us”). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. The service

Wishkister lets you create and share wishlists and wishes, connect with friends, and organize gift exchanges through a “Secret Santa” feature. We may add, change, or remove features over time.

2. Your account

You sign in using Sign in with Apple. You are responsible for activity under your account and for keeping your device secure. You must be at least 13 years old (or the minimum age required in your country) to use the App.

3. Acceptable use

You agree not to:

• upload unlawful, infringing, offensive, or harmful content;
• impersonate others or misuse another person’s information;
• attempt to disrupt, reverse-engineer, or gain unauthorized access to the App or its backend;
• use the App for any unlawful purpose.

We may suspend or terminate accounts that violate these Terms.

4. Your content

You retain ownership of the content you create (wishlists, wishes, images, group details). You grant us a limited license to store, display, and share that content solely to operate the App and provide its features (for example, showing your wishlist to a friend you shared it with). You are responsible for the content you add, including the names of external participants you enter.

5. Subscriptions and purchases

• Wishkister offers an optional Premium subscription (monthly auto-renewable) and a one-time lifetime purchase, unlocking additional features.
• Purchases are processed by Apple through the App Store. Prices are shown in the App before purchase; any converted prices shown in another currency are approximate, and you are charged in your App Store region’s currency.
• Auto-renewable subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. You manage or cancel subscriptions in your Apple ID settings (App Store → Subscriptions).
• Payments, billing, and refunds are handled by Apple under Apple’s terms. We do not process payments and cannot issue refunds directly; refund requests are made through Apple.

6. Intellectual property

The App, its design, and its trademarks are owned by us and protected by applicable law. These Terms do not grant you any rights to our intellectual property other than to use the App as permitted.

7. Disclaimers

The App is provided “as is” and “as available,” without warranties of any kind, to the fullest extent permitted by law. We do not warrant that the App will be uninterrupted, error-free, or secure.

8. Limitation of liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, or consequential damages arising from your use of the App. Nothing in these Terms limits liability that cannot be limited under applicable law, including your statutory consumer rights.

9. Termination

You may stop using the App and delete your account at any time from Settings → Delete Account. We may suspend or terminate access if you violate these Terms or where required by law.

10. Governing law

These Terms are governed by the laws of the Czech Republic, without prejudice to any mandatory consumer-protection rights you may have under the law of your country of residence. Disputes shall be subject to the competent courts of the Czech Republic, again without affecting mandatory consumer rights.

11. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by updating the “Last updated” date above. Continued use of the App after changes take effect constitutes acceptance.
